The new ordinance introduces two enforcement mechanisms:
Adjudicated Trespass Warnings, issued by a neutral hearing officer after a formal hearing, and Immediate Trespass Warnings, issued by law enforcement in cases of dangerous or disruptive behavior.
Courts have emphasized the importance of due process and clear standards in municipal trespass systems.
The ordinance aims to meet these requirements by balancing public safety with fair access to public spaces.
It mandates signage to inform the public that entry by individuals with active trespass warnings is unauthorized and may lead to criminal charges.
Immediate trespass warnings can be issued for actions such as physical harm threats, weapon brandishing, intimidating minors, or vandalism requiring facility repairs.
The ordinance includes exceptions for constitutionally protected activities like free speech and prohibits targeting individuals based on perceived homelessness unless they commit a specific violation.
